¹ýÀûº°°Å(legal separation) »çÀ¯¿Í ±× È¿·Â


I. ¹ýÀûº°°Å »çÀ¯

  
Art. 55. A petition for legal separation may be filed on any of the following grounds:
     (1) Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner; ¹è¿ìÀÚ³ª °¡Á·À» ¹Ýº¹ÀûÀ¸·Î ±¸Å¸, ¼ºÀû ÆøÇà
     (2) Physical violence or moral pressure to compel the petitioner to change religious or political affiliation; Á¾±³³ª Á¤Ä¡ÀûÀÎ ÀÌÀ¯·Î ź¾Ð
     (3) Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution, or connivance in such corruption or inducement; ¹è¿ìÀÚ³ª ÀÚ³àµé¿¡°Ô ¸ÅÃá µîÀ» °­¿ä
     (4) Final judgment sentencing the respondent to imprisonment of more than six years, even if pardoned; 6³â ÀÌ»óÀÇ Â¡¿ªÇüÀÌ È®Á¤µÈ °æ¿ì
     (5) Drug addiction or habitual alcoholism of the respondent; ¸¶¾à, ¾ËÄÝ Áßµ¶
     (6) Lesbianism or homosexuality of the respondent; µ¿¼º¾Ö
     (7) Contracting by the respondent of a subsequent bigamous marriage, whether in the Philippines or abroad; ÁßÈ¥, º¹È¥À» ÇÏ´Â °æ¿ì
     (8) Sexual infidelity or perversion(annulment »çÀ¯°¡ ¾Æ´Ô); ¿Üµµ ¶Ç´Â º¯Å ¼º¿å

     (9) Attempt by the respondent against the life of the petitioner; »ý¸íÀÇ À§Çùor
    (10) Abandonment of petitioner by respondent without justifiable cause for more than one year. 1³â ÀÌ»ó ¿¬¶ôµÎÀý ¹× ¹æÄ¡
     For purposes of this Article, the term "child" shall include a child by nature or by adoption. (9a)


Art. 56. The petition for legal separation shall be denied on any of the following grounds: ´ÙÀ½ÀÇ °æ¿ì¿¡´Â º°°Å°¡ ºÒÇãµÈ´Ù.
     (1) Where the aggrieved party has condoned the offense or act complained of; »ó´ë¹æ ¹è¿ìÀÚ°¡ ¿ë¼­ÇÑ °æ¿ì
     (2) Where the aggrieved party has consented to the commission of the offense or act complained of; »ó´ë¹æ ÇàÀ§¿¡ »çÀü µ¿ÀÇÇÑ °æ¿ì

     (3) Where there is connivance between the parties in the commission of the offense or act constituting the ground for legal separation; ÇàÀ§¿¡ ´ëÇØ ¹¬ÀÎÇÑ °æ¿ì
     (4) Where both parties have given ground for legal separation; ½Ö¹æ ¹è¿ìÀÚ ¸ðµÎ º°°Å»çÀ¯¸¦ Á¦°øÇÑ °æ¿ì
     (5) Where there is collusion between the parties to obtain decree of legal separation; ½Ö¹æ ¹è¿ìÀÚ°ø¸ðÇÏ¿© ½ÅûÇÏ´Â °æ¿ì; À̸¦ Á¶»çÇϱâ À§ÇÑ °Ë»ç(prosecutor)°¡ ÁöÁ¤µÈ´Ù. or
     (6) Where the action is barred by prescription. (100a) ¼Ò¸ê½ÃÈ¿/Á¦Ã´±â°£ÀÌ µµ°úÇÑ °æ¿ì


Art. 57. An action for legal separation shall be filed within five years from the time of the occurrence of the cause. (102) º°°Å½ÅûÀº »çÀ¯¹ß»ýÀϷκÎÅÍ 5³â À̳»¿¡ Á¦ÃâÇÏ¿©¾ß ÇÑ´Ù.


II.¹ýÀûº°°ÅÀÇ È¿·Â


Art. 61. After the filing of the petition (before decree of legal separation, MO) for legal separation, the spouses shall be entitled to live separately from each other.
The court, in the absence of a written agreement between the spouses, shall designate either of them or a third person to administer the absolute community or conjugal partnership property. The administrator appointed by the court shall have the same powers and duties as those of a guardian under the Rules of Court. (104a) ÀÏ´Ü º°°Å½Åû¸¸ À־ Àç»ê°ü¸®ÀÎÀÌ ÁöÁ¤µÇ°í ±× °ü¸®ÀÎÀÌ ÀçÆÇ È®Á¤¶§±îÁö ºÎºÎ°øµ¿Àç»êÀ» ÇѽÃÀûÀ¸·Î °ü¸®ÇÑ´Ù.


Art. 62. During the pendency of the action for legal separation, the provisions of Article 49 shall likewise apply to the support of the spouses and the custody and support of the common children. (105a) ÀçÆÇ °è¼Ó Áß ÀÚ³à´Â ÀÚ½ÅÀÇ ¼±Åÿ¡ µû¶ó ¾î´À ÇÑ ºÎ¸ð¿¡ ÀÇÇØ ¾çÀ°µÇ¸ç Ÿ ¹è¿ìÀÚ´Â Á¢°ß±ÇÀ» °¡Áø´Ù.


Art. 63. The decree of legal separation shall have the following effects:º°°Å¸í·ÉÀÇ È¿·Â
    (1) The spouses shall be entitled to live separately from each other, but the marriage bonds shall not be severed; ºÎºÎ´Â º°°ÅÇÒ ¼ö ÀÖÀ¸³ª ¹è¿ìÀÚ °ü°è´Â À¯ÁöµÈ´Ù.
     (2) The absolute community or the conjugal partnership shall be dissolved and liquidated but the offending spouse shall have no right to any share of the net profits earned by the absolute community or the conjugal partnership, which shall be forfeited in accordance with the provisions of Article 43(2). ºÎºÎÀÇ Àç»êÀº ¾çºÐµÈ´Ù. ±×·¯³ª ±ÍÃ¥(offending) ¹è¿ìÀÚÀÇ Àç»ê Áß °áÈ¥ Áß¿¡ °øµ¿Àç»êÀ» ÀÌ¿ëÇØ ¾òÀº ÀÌÀÍÀº ÀÏ´Ü ÀÚ³à ¸òÀ¸·Î µÈ´Ù. °á±¹ ¾çÀ°±ÇÀ» °®´Â »ó´ë¹æ ¹è¿ìÀÚ°¡ °ü¸®ÇÏ°Ô µÈ´Ù.(mo);
     (3) The custody of the minor children shall be awarded to the innocent spouse, subject to the provisions of Article 213 of this Code; ¿øÄ¢ÀûÀ¸·Î ¹«Ã¥(innocent) ¹è¿ìÀÚ°¡  ¾çÀ°±ÇÀ» °®´Â´Ù. and
    (4) The offending spouse shall be disqualified from inheriting from the innocent spouse by intestate succession. Moreover, provisions in favor of the offending spouse made in the will of the innocent spouse shall be revoked by operation of law. (106a) ±ÍÃ¥¹è¿ìÀÚ´Â ¹«Ã¥ ¹è¿ìÀÚÀÇ Àç»êÀ» »ó¼Ó¹Þ°Å³ª »çÀÎÁõ¿©¹ÞÁö ¸øÇÑ´Ù.
