9(g)-Commercial Visa Extension 구비서류
신규신청과 연장신청은 그 구비서류 및 절차에 있어 대동소이합니다. 여기서는 이 둘 간의 차이점을 중심으로 설명드리기로 하겠습니다.
폴더를 2개 준비합니다. 하나는 비자연장심사를 위한 구비서류를 담게되고, 다른 하나는 비자연장 승인 후 ACR I-Card 재발급에 필요한 서류를 담게 됩니다. 비자연장심사를 위한 폴더는 다음의 모든 서류를 포함하게 되나, I-Card 재발급 폴더에는 2 및 8의 서류들만 포함하면 됩니다.
1. Joint Letter Request addressed to the Commissioner from the petitioner and applicant
회사의 로고(letter head)가 인쇄된 용지를 사용하도록 합니다. 이 letter에는 다음의 문구들이 반드시 포함되어야 합니다.
“all documents submitted were legally obtained from the corresponding government agencies”
"The above-named establishment is a corporation/partnership/single propriertorship duly organized and existing under the laws of the Philippines with principal office at...."
Petitioner의 대표자(petitioner’s representative) 그리고 신청인(applicant) 둘 다 기명하고 서명하여야 합니다.
작성이 끝난 letter는 공증을 받도록 합니다. 작성예를 첨부하오니 참조하시기 바랍니다.
2. Duly accomplished Consolidated General Application Form for Non-Immigrant Visa
이민국에서 제공하는 신청서 양식(BI Form CGAF-002-Rev 2) 입니다. 동일한 내용으로 2부를 작성하며 기재사항은 모두 대문자로 기재합니다. 해당사항이 없는 항목은 “N/A”라고 기재합니다.
좌측상단에 2*2 인치 컬러사진을 부착합니다.
I. APPLICATION INFORMATION
Present Immigration Status에는 "9(G) COMMERCIAL VISA"라고 기재합니다.
Nature of Application: “Extension”에 체크합니다.
Type of Visa/Permit Application에는 “9(G) VISA COMMERCIAL EXTENSION”이라고 기재합니다.
Number of Months/Years Applied For에는 AEP card에 기재된 유효기간, 즉 고용기간과 같거나 짧은 기간에 체트하십시요.
Method of application: applicant 본인이 직접 서류를 제출하는 경우에는 “personal”에 체크하시고, 여행사 기타 대리인에 의한 경우에는 “Authorized representative”에 체크하여야 합니다.
Accreditation number: 위에서 “personal”에 체크한 경우나 여행사 이외의 대리인에 의한 경우에는“N/A”라고 기재합니다. 여행사를 통한 경우에는 여행사의 이민국 인가번호를 기재합니다.
Name of authorized representative: 위에서 “personal”에 체크한 경우에는 “N/A”라고 기재하고, “Authorized representative”에 체크한 경우에만 대리인의 이름을 기재합니다.
Position in the Company/Institution: 신청인의 회사직책을 기재합니다. 예: Director, Manager 등
II. APPLICANT'S TRAVEL INFORMATION
여권의 기재사항과 여권에 찍힌 스탬프들을 참조하여 기재하도록 합니다. 특히, Last day of Authorized stay에는 비자 만료일(expiry date)을 기재합니다.
III. APPLICANT'S PERSONAL INFORMATION
신청인과 그 피부양자에 관한 인적사항을 기재합니다.
Name of spouse, Name of children and date of birth에는 해당사항을 기재하고 배우자나 자녀가 없으면 “N/A”라고 기재합니다.
IV. PETITIONER'S INFORMATION
- Name of Institution: Corporation이나 partnership 의 경우에는 그 회사의 명칭을 기재하고, single proprietorship인 경우에는 상호(Trade name)를 기재합니다.
- Registration Number: Corporation이나 partnership 의 경우에는 SEC 등록번호를 기재하고, single proprietorship인 경우에는 DTI 등록번호를 기재합니다.
- Registered address in the Philippines에는 petitioner의 사무소 주소를, Contact number 에는 전화번호를 기재합니다.
V. ACR I-CARD
기존의 ACR I-CARD를 참조하여 기재하면 됩니다. 특히 Alien Certificate of Registation Number에는 I-Card의 앞면 우측상단에 기재된 번호를 적습니다. Certificate of residence number에는 I-Card의 앞면 중앙하단에 있는 "CR"로 시작하는 일련번호를 기재하면됩니다.
그 아래에는 작성일자를 기재하고 그 옆에 회사대표장(petitioner'representative)와 신청인(applicant)인 각각 기명하고 서명합니다. 그 이하는 작성하지 않습니다.
이 양식은 공증을 필요로 하지 않습니다.
3. Photocopy of renewed Employment Contact, Secretary's Certificate of Election, Appointment or Assignment of applicant, or equivalent document, with details of exact compensation, duration of employment and comprehensive description of nature and scope of the applicant's position the company
고용계약서 복사본을 제출하면 되는데 계약서에는 반드시 고용기간과 급여에 대해 기재되어 있어야 합니다.
4. Photocopy of the following:
a. General Information Sheet (GIS) for the current year stamped received by the SEC (for Corporations or Partnerships); or
법인 또는 파트너쉽인 경우에는 당해년도에 SEC에 제출한 GIS를 복사하여 제출합니다.
b. Mayor’s Permit for the current year (for Single Proprietorships);
개인사업자의 경우에는 당해년도 영업허가증 사본을 제출합니다.
5. Photocopy of petitioner’s latest Income Tax Return (ITR) with the corresponding proof of payment (official receipt, bank teller’s
validation slip, BIR’s eFPS payment details’ print-out or other similar evidence);
가장 최근에 BIR에 제출한 세금신고서(ITR)의 사본을 제출하여야 합니다. 이때 영수증 기타 세금을 낸 증거를 같이 제출하여야 합니다.
6. Photocopy of Alien Employment Permit (AEP) issued by the Department of Labor and Employment (DOLE);
새로 발급받은 AEP Card의 앞면을 복사하여 제출합니다.
7. Notarized certification of number of foreign employees from the petitioning company
회사의 피고용인 숫자를 밝히는 증명서입니다. 자국민과 외국인의 숫자를 분리하여 기재합니다. 이민국 홈페이지에서 양식을 다운받으실 수 있습니다. 이 증명서를 요구하는 배경은 다음과 같습니다. 어느 나라인건 자국민 보호정책에 따라 외국인근로자는 제한적, 보충적으로만 허용하는 법규정을 두고 있습니다. 즉 자국민 중에서 필요한 인력을 수급할 수 없는 경우에 한해서 외국인을 고용하도록 강제하는 것입니다.
그래서 이 증명서는 회사가 필요 이상으로 외국인을 고용하고 있지 않은가를 감시하기 위한 것입니다. 따라서 가급적 외국인 근로자의 수를 적게 기재하는 것이 유리합니다.
8. Photocopy of passport bio-page, visa implementation page and latest admission with valid authorized stay;
여권 중 사진이 부착된 페이지, 종전 워킹비자 스탬프가 찍힌 페이지 그리고 마지막 입국시 받은 스탬프가 찍힌 페이지를 한 부씩 복사합니다.
9. BI Clearance Certificate; and
이것은 따로 준비할 필요는 없습니다. 제출절차 중 담당자가 직권 발행합니다. 물론 수수료는 내야합니다.
10. Original or certified true copy of Bureau of Quarantine Medical Clearance, if applicant is a national of any of the countries listed under Annex “A” of Immigration Operations Order No. SBM-14-059-A who arrived in the Philippines on or after June 2014.
대한민국 국민은 해당사항이 없습니다.
배우자나 미혼자녀(21세 미만)는 “dependant(피부양자)”라고 분류됩니다. 아래의 서류들을 피부양자별로 준비하여 별개의 폴더에 담도록 합니다. 피부양자 별로 2개의 폴더가 더 필요한 것입니다.
Checklist of Documentary Requirements for EACH Dependent
1. Duly accomplished CGAF for Non-Immigrant Visa;
본인과 별개의 form에 피부양자별로 작성하여야 한다.
2. Photocopy of passport bio-page, visa implementation page and latest admission with valid authorized stay;
위에서와 마찬가지로 피부양자별로 여권 페이지들을 복사합니다.
3. Proof of filiation with the applicant;
가족관계확인서을 제출하여야 합니다. 먼저 가족관계확인서를 발급 받은 후 여기에 한국대사관과 DFA의 확인을 받아야 합니다.
4. BI Clearance Certificate; and
이것은 따로 준비할 필요는 없습니다.
5. Original or certified true copy of Bureau of Quarantine Medical Clearance, if applicant is a national of any of the countries listed under Annex “A” of Immigration Operations Order No. SBM-14-059-A who arrived in the Philippines on or after June 2014.
대한민국 국민은 해당사항이 없습니다.
구비서류는 상기 순서에 따라 폴더에 차례대로 담아 클립으로 고정합니다.
만약 기존의 I-Card에 기재된 주소와 비자연장신청서에 기재된 신청인의 주소(Applicant's Residential address)가 다를 경우에는 새로운 주소를 소명하기 위한 서류와 비용을 추가로 제출하여야 합니다. 추가서류들로는 Affidavit of Change of Address와 Certificate of Residence by Barangay 등이 있습니다. 이 서류들은 상기 I-Card 재발급 폴더에 철합니다. 가급적이면 AEP card, 고용계약서 등에 기재된 주소와도 일치시키기 바랍니다.
