워킹 비자구비서류 준비하기
상업용 워킹비자{Sec. 9(g)} 구비서류는 다음과 같으며, 서류 별로 자세히 설명한다.
각각의 서류 준비
먼저 알아야 하는 것이 petitioner와 applicant의 구별이다. Corporation이나 partnership 의 경우에는 그 회사가 Petitioner가 되며, CEO, president등이 그 회사를 대표(representative)하여 서명을 한다. Single proprietorship인 경우에는 그 상호가 Petitioner이고 그 개인사업자가 대표자가 된다. 반면 applicant는 비자를 받고자 하는 피고용인이 된다.
1. Letter Request
Petitioner의 대표자(petitioner’s representative)가 작성/서명하는데 가급적 회사의 letter head가 인쇄된 용지를 사용하도록 한다. 이 letter에는 다음의 문구가 반드시 포함되어야 한다. “all documents submitted were legally obtained from the corresponding government agencies” <첨부 참조> . petitioner’s representative의 TIN No. 또는 passport No.를 잊지말고 기재하자. 공증도 받아야 한다.
2. Consolidated General Application Form (BI Form No. RADJR-2012-02)
이민국에서 제공하는 신청서 양식이다. 동일한 내용으로 2부를 작성하며 기재사항은 모두 대문자로 기재한다. 해당사항이 없는 항목은 “N/A”라고 기재한다.
사진은 2*2 인치 컬러사진을 부착한다.
Nature of Application: “conversion”에서 체크한다.
Type of visa Application: Non-immigrant visa/permit applied for에는 “9(g)”
라 기재하고 Present Immigration status에는 관광비자 소지자라면 “9(a)”로 기재한다.
Last day of Authorized stay에는 비자 만료일(expiry date)을 기재하는데 이 날짜가 비자신청서류 제출일로부터 20일 이상 남아 있어야 하므로 19일 이내인 경우 먼저 비자를 연장하여야 한다.
Method of application: applicant 본인이 직접 서류를 제출하는 경우에는 “personal”에 체크하고, 여행사 기타 대리인에 의한 경우에는 “Authorized representative”에 체크하여야 한다.
Accreditation number: 위에서 “personal”에 체크한 경우나 여행사 이외의 대리인에 의한 경우에는“N/A”라고 기재하고 한다. 여행사를 통한 경우에는 여행사의 이민국 인가번호를 기재한다.
Name of authorized representative: 위에서 “personal”에 체크한 경우에는 “N/A”라고 기재하고, “Authorized representative”에 체크한 경우에만 대리인의 이름을 기재한다.
Name of applicant, spouse/wife/husband, Name of children and date of birth에는 해당사항을 기재하고 해당되지 않으면“N/A”라고 기재한다.
Character reference in the Philippines는 이미국에서 비자 심사과정 중 applicant의 신상에 대해 궁금점이 있을 때 대답해 줄 사람을 적는 란이다. 따라서 아는 필리핀 사람 중 친분이 있는 사람의 성명 등을 기재한다. 실제로 이민국에서 전화를 거는 경우는 드물지만 만약에 대비해서 위 필리핀인에게 자초지종을 얘기해 두고 협조를 구하도록 한다.
Petitioner’s information:
- Name of petitioner: Corporation이나 partnership 의 경우에는 그 회사의 명칭을 기재하고, single proprietorship인 경우에는 상호(Trade name)를 기재한다.
- Registration Number: Corporation이나 partnership 의 경우에는 SEC 등록번호를 기재하고, single proprietorship인 경우에는 DTI 등록번호를 기재한다.
- Registered address of petitioner와 contact number 에는 사무소 주소와 전화번호를 기재한다.
- Name of petitioner’s representative 와 position in the company에는 서두에 얘기한 대표자의 이름과 직책을 기재한다.
Applicant’s other Information:
- Proposed position, expiration of contract 및 actual gross monthly salary에는 고용계약서에 나와 있는대로 적으면 된다. Salary는 너무 큰 액수를 적으면 회사의 모든 수익을 피고용인이 가져간다는 인상을 줄 수 있으니 현실적인 액수로 낮추어 기재한다.
- AEP number 및 Expiry date/valid until에는 AEP카드에 표시된 대로 기재하면 된다.
Applicant’s travel Information: 여권을 참조하여 기재한다.
ACR I-CARD: applicant가 소지하고 있는ACR I-CARD를 참조하여 기재한다. Certificate of residence number에는 “N/A”라 기재한다.
Applicant’s ACR I-CARD CLAIM STUB에는 일단 기재를 생략한다.
보다 자세한 기재방법은 첨부한 "General Instruction" 뒷면을 참조하기 바란다.
3. Curriculum Vitae of Applicant
Applicant의 이력서를 말하는데PERSONAL INFORMATION, EDUCATIONAL BACKGROUND, EMPOYMENT RECORD, CHARATER REFERENCES 등을적으면 된다. <첨부 문서>를 참조하기 바란다.
4. Photocopy of Employment Contact or Secretary's Certificate of Election, Appointment or Assignment of applicant, or equivalent document, with details of exact compensation and duration of employment 고용계약서 복사본을 제출하면 되는데 계약서에는 반드시 고용기간과 급여에 대해 기재되어 있어야 한다. AEP, 워킹비자 등을 진행하다 보면 최초 고용계약일로부터 몇개월이 흘러버릴 수도 있어 3년짜리 워킹비자를 받더라도 실제기간은 그보다 짧아질 수 있다. 따라서 다음과 같이 계약서를 작성하여 고용계약 기간을 AEP 발급일로부터 기산하도록 하는 것이 바람직하다. The Initial Term of this Agreement shall commence upon approval and issue of Alien Employment Permit by Department of Labor and Employment and Working Visa (9(g)) by Bureau of Immigration and it shall thereafter continue in effect for a period of three (3) years.
5. Photocopy of SEC Certificate of Registration, Articles of Incorporation(정관) and General Information Sheet(GIS) in case of corporation or partnership, of photocopy of DTI Certificate of Registration of Business Name in case of single proprietorship
Corporation또는partnership인 경우에는 SEC 등록증, 정관 및 GIS를 복사하여 제출하고, single proprietorship의 경우에는 DTI trade name 등록증를 복사하여 제출하면 된다. GIS는 매년 정기총회일로부터 30일 이내에 SEC에 제출하는 보고서인데 신생 회사의 경우 아직 제출한 적이 없을 수도 있다. 이 경우에는 제출하지 아니한 사유를 기재한 Affidavit을 representative의 명의로 작성, 공증 받아 제출한다<첨부 참조>.
6. Photocopy of Petitioner's latest Income Tax Return with the Official Receipt of payment or Audited Financial Statement stamped "received" by the BIR
모든 사업자들은 매 분기마다 BIR에 소득세 신고서(Income Tax Return)를 제출하여야하고 일년에 한 번씩 회계보고서를 제출하여야 한다. 위 둘 중 하나를 복사하여 제출하면 된다.
7. Photocopy of Alien Employment Permit (AEP) issued by DOLE
AEP카드의 앞면을 복사하여 제출한다.
8. Original copy of newspaper clipping showing publication of the application for AEP
AEP 발급 절차 중에 신문공고 과정이 있는데 이 때 발행된 신문의 해당부분을 스크랩해 보관해 두어야 한다. 만약 분실하였다면 이민국 근처의 DOLE 본청에 방문하거나 해당 신문사(Daily Inquirer)에 문의하면 구할 수 있다고 들었다.
9. Photocopy of applicant's Passport showing its biodata page, admission and authorized stay of at least twenty (20) days from the date of filing
여권의 사진이 붙어있는 페이지, 입국도장이 찍힌 페이지, 최근 비자연장 도장이 찍힌 페이지를 복사한다. 앞서 말했지만 비자기간은 워킹비자일로부터 최소 20일 이상 남아 있어야 한다.
10. Original copy of Bureau of Immigration (BI) Clerance Certificate.
관광비자를 연장하면서 받은 Certificate of clearance의 원본을 제출한다. Certificate 발급일이 오랜된 경우에는 새로이 발급받아 제출하라고 요구할 수 도 있다.
배우자 및 자녀가 있는 경우의 추가 제출 서류
If in the application, the applicant is joined by his/her spouse and unmarried minor children:
이 경우 applicant은 “principal(본인)”이라 호칭하며 배우자나 자녀(미혼, 21세 미만)는 “dependant(피부양자)”라고 호칭한다. 아래의 서류들은 피부양자별로 준비하여 별개의 폴더에 담도록 한다.
1. Duly accomplished and notarized Consolidated General Application Form (BI Form No. RADJR-2012-02)
본인과 별개의 form에 피부양자별로 작성하여야 한다.
2.Original copy of Marriage Contract of applicant and spouse and/or Birth Certificate of unmarried child, under twenty-one years of age authenticated by the Philippine Embassy/Consulate in or nearest the place where the marriage was solemnized/place of birth, with English translation if written in other foreign language
한국에서 결혼한 경우라면 서류가 좀 복잡해진다. 먼저 한국에서 (1)영문 가족관계확인서를 발급받는다. 이 가족관계확인서는 외교부에 가서 (2)인증서을 받아야 하고 다시 주한 필리핀 대사관에 가서 다시 (3)인증서를 받아야 한다. (2)는 (1)을 확인해주는 것이고 (3)은 다시 (2)를 확인해주는 것이다.
3. Photocopy of dependent/s Passport (biodata page, admission and authorized stay of at least twenty (20) days from the date of filing)
위에서와 마찬가지로 부양자별로 여권을 복사하다.
4. Original copy of the Bureau of Immigration (BI) Clearance Certificate.
상기 서류 이외에도 대리인을 통해 신청하는 경우에는 개별 위임장(Special Power of Attorney)을 작성하여 함께 제출하여야 한다. 공증을 필요로 한다.
구비서류는 체크리스트에 기재된 순서에 따라 폴더에 차례대로 담아 클립으로 고정한다. 이민국 고객센터에서 대신 해주기도 한다.
이민국 1층 중앙의 고객센터(Public information & Assistance counter and Public attorney ‘s desk)에서는 이민국에서 제공하는 서류 양식들을 나누어 준다. 여기에서 구비서류에 관한 기본적인 사항들을 문의할 수 있다. 그리고 그 뒷줄에는 이민국 소속 변호사들이 무료로 문서 공증을 해준다.
